Terms & Conditions

These Terms & Conditions (“Terms”) form the agreement between James Bignell Photography (“we,” “us,” “our”) and the client (“you,” “your”). By booking, purchasing, or using our services, you accept these Terms in full.
1. Booking & Payment
1.1 A non-refundable booking fee/session fee is required to secure your date. No booking is confirmed until the fee is received.
1.2 The remaining balance is due on or before the date specified in your booking confirmation.
1.3 Late or non-payment may result in cancellation of services and loss of booking fee.
2. Cancellations & Rescheduling
2.1 If you cancel your session, the booking fee is non-refundable.
2.2 Cancellations made within [X days] of the session may result in full payment being due.
2.3 Rescheduling is permitted at our discretion, subject to availability.
2.4 If we are unable to perform the agreed services due to illness, accident, equipment failure, or circumstances beyond our control, we will:
Attempt to reschedule, or
Provide a full refund of fees paid (limited to the amount received, with no further liability).
3. Client Responsibilities
3.1 You agree to arrive on time and cooperate fully during the session. Late arrival may result in reduced shooting time without refund.
3.2 You are responsible for obtaining permissions, permits, or consents required for the shoot location.
3.3 You must ensure that guests or participants follow instructions to avoid disruption.
4. Use of Cameras, Phones & Video During Sessions
4.1 Clients and guests are strictly prohibited from taking photographs or recording video during any portrait session.
This does not apply to events such as weddings, parties or social gatherings. Only family portrait sessions and specific portrait shoots.
4.2 If you or your guests attempt to take photographs or video (including with mobile phones), the session will be immediately terminated and your session fee forfeited.
4.3 Copying, reproducing, or imitating our work (including screenshots, scans, or unauthorised editing) will incur a contractual penalty of £1,000, payable within 14 days.
5. Copyright & Image Usage
5.1 All photographs remain the sole copyright of James Bignell Photography under the Copyright, Designs and Patents Act 1988 (UK).
5.2 You are granted a non-exclusive, non-transferable, personal licence to use the images for personal use (e.g., printing, sharing with family/friends, and personal social media).
5.3 Images must not be altered, edited, or filtered in a way that misrepresents our work.
5.4 Commercial use, resale, publication, or entry into competitions requires prior written consent and an additional fee.
5.5 We reserve the right to use images for portfolio, website, exhibitions, competitions, and marketing purposes unless you specifically decline in writing before the session.
6. Model Release
6.1 By booking our services, you consent to being photographed and grant us permission to use your likeness in promotional materials, unless you notify us in writing prior to the session.
6.2 If you decline, your images will not be used publicly.
7. Online Galleries & Print Orders
7.1 Client galleries are hosted online and protected by a password. You are responsible for sharing access only with those you choose.
7.2 Digital downloads and print orders are licensed for personal use only.
7.3 We cannot guarantee permanent storage of client galleries. Archival is provided at our discretion.
8. Delivery of Images
8.1 Proof galleries are typically delivered within [X weeks]. Final edited images will follow selection/payment as agreed.
8.2 Delivery times are estimates, not guarantees.
8.3 Colour and quality may vary across screens, devices, and print labs outside our control.
9. Liability
9.1 We take every care with your session and images. In the unlikely event of camera, storage, or technical failure, our liability is limited to the return of fees paid.
9.2 We are not liable for circumstances outside our control, including weather, lateness, accidents, restrictions at locations, or interference from guests.
9.3 We cannot be held responsible for missed shots due to client lateness, lack of cooperation, or restrictions imposed by venues.
10. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our control, including but not limited to fire, flood, natural disaster, strike, pandemic, travel restrictions, or government orders.
11. Dispute Resolution
11.1 Any disputes shall first be attempted to be resolved amicably through written communication.
11.2 If unresolved, disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
11.3 These Terms are governed by the laws of England and Wales.
12. Acceptance of Terms
By booking with James Bignell Photography, you acknowledge that you have read, understood, and agree to these Terms.
